Ever
wonder why there is a flap on the back of
the housing of your power lawnmower that
prevents roll-back accidents that amputate
toes and feet, or why your circular saw
has a safety brake, or why there are child-proof
bottle caps and rear-door child security
locks on our cars, or why there are printed
safety warnings that come attached to so
many of the mechanical products we buy?
The answer is because personal injury lawyers,
who have sued manufacturers for people who
have suffered injury from defective and
dangerous products, have made it standard
operating procedure for manufacturers to
go the extra distance to make the use of
their products safe. All of these changes
have come from litigation. When personal
injury lawyers make it too costly for uncaring
manufacturers to ignore the dangers to the
public, corporate thinking changes and products
become safer.
The
lawyers of Z & F have a long history
of success in going after negligent manufacturers.
It was due to a hard fought case brought
by partner Alan Zwiebel that the Consumer
Product Safety Commission went after Robert-Shaw
Controls for concealing from the public
that dozens of people were maimed and killed
by a defective hot water heater control.
(Gilberti v. Robert-Shaw Controls). Partner
Jonathan Fairbanks sued White-Westinghouse
because that company failed to provide consumers
with a method to prevent a improperly designed
electric stoves from tipping over, One of
their stoves caused a child to suffer horrible
3rd degree burns over her entire back. White-Westinghouse
paid $2,2000,000 to the child and is now
conducting a recall advising of the dangers
(Germond
v. White- Westinghouse). When the first
liter and 2 liter soda containers were made
they were made of glass and covered with
Styrofoam. The glass made them too heavy
for children to safely hold, the Styrofoam
covered defects in the glass and could hold
a damage bottle together. In Lindsay v Coca
Cola, Alan Zwiebel obtained a recovery for
a child blinded when a liter of Coca Cola
exploded. Now the containers are made of
lightweight plastic.
If

by because a product didn’t work the
way it should have, didn’t warn of
danger in inherent in its use or had a manufacturing
defect please call us. We are interested
in helping you recover and making it a safer
world.
