We
all want to believe that nursing homes are
places where our loved ones are well cared
for. Unfortunately, that is not always the
case. Abuse and neglect in nursing homes
is a reality. The National Nursing Home
Survey of 1995 reported that 66% percent
of all nursing homes are operated for profit.
When profit is the motive owners and operators
look for ways to cut corners and save money.
They hire less staff and inexperienced workers.
Some nursing homes even hire employees with
questionable work histories in order to
cut costs. What that means is that the nursing
home caregivers are often under qualified
and those who are competent are often overworked
and frustrated. This situation can, and
too often does, ultimately result in neglected
and abused patients.
In
response the State of New York has enacted
Public Health Law 2803-e to create a “public
policy” to protect nursing home residents
and which specifically sets out the rights
of patients and the responsibilities of
a nursing home to its patients. This law
states that residents have a “right
to receive adequate and appropriate medical
care.” Anything less would be an abandonment
of a duty to the elderly and the infirm.
Injuries such as bedsores and bruises are
