We all want to believe that nursing homes are places where our loved ones are well
looked after. Unfortunately, that is not always the case. Abuse and neglect in nursing

The National Nursing Home Survey of 1995 reported that 66% percent of all nursing homes are operated for profit. In response, the Federal Government enacted the Federal Nursing Home Reform Act;
42 USC 1396r and the State of New York has enacted Public Health Law 2803-e to
create a “public policy” to protect nursing home residents and which specifically sets
out the rights of patients and the responsibilities of a nursing home to its patients.
The Federal statute states that every resident of a nursing home has the right to attain or maintain the highest practicable physical and mental state. The New York law states that residents have a “right to receive adequate and appropriate medical
