Property owners, especially businesses, have a

to patronize their stores and shops, to keep the
premises safe. However, too often it means that
money must be spent to repair and replace broken
sidewalks and hazardous steps and stairs, or to
keep a walkway free of ice, or to provide adequate
lighting.
In
a case that partner Jonathan Fairbanks prosecuted
against the New York State Port Authority (Weig
v. New York Port Authority), we won a settlement
of $1.25 million. Mr. Weig was working on a construction
job at JFK Airport. There were holes that had
been created, but which were not protected or
otherwise covered. Mr. Weig, while in the process
of doing his own job, had to take a couple of
steps backward and stepped right into one of those
holes. His injury was so severe that he was no
longer able to work construction. This settlement
made it possible for Mr Weig to be able to support
himself, maintain his dignity and not have to
depend on public assistance to get by. For Mr.
Weig, Zwiebel and Fairbanks were the “RIGHT
